Terms of Use

1. Context and Acceptance

The AppGuide.ca platform (the “Platform”) is designed and operated by AppGuide Inc. (“AppGuide”, “we”, or “us”). It includes, among other things, the AppGuide.ca website as well as thematic portals accessible through subdomains, including, without limitation, femme.appguide.ca and medicament.appguide.ca.

The Platform provides citizens and healthcare professionals with access to information, resources, directories, digital content, and self-care tools, as well as links to resources or tools developed, operated, or maintained by third parties, as applicable.

By accessing or using the Platform, you acknowledge that you have read these Terms of Use and agree to be bound by them. If you do not agree with these Terms, you must stop using the Platform.

2. Definitions

For the purposes of these Terms:

“Self-care tools” means publicly accessible digital resources, including applications, websites, or digital content, intended to support users’ self-care practices, and developed, operated, and maintained by independent third parties or, as applicable, by AppGuide or its partners.

“Content” means all texts, visuals, logos, interfaces, databases, documents, features, graphic elements, software, code, directories, links, and other content made available on the Platform.

3. Eligibility and General Use

The Platform is intended for users aged 14 and older. If you are under 14 years of age, you must not use the Platform without the consent of your parent or the holder of parental authority, where required.

You agree to use the Platform only in a lawful manner, in accordance with these Terms, and in a way that respects the rights of AppGuide and third parties.

It is strictly prohibited to use the Platform in a way that:

  • violates any applicable law, regulation, order, or obligation;

  • infringes the rights of others;

  • attempts to access, without authorization, any part of the Platform, its systems, accounts, servers, or data;

  • bypasses, disrupts, compromises, or tests the vulnerability of the Platform’s security measures without written authorization;

  • copies, reproduces, republishes, distributes, sells, rents, licenses, modifies, adapts, translates, or commercially exploits all or part of the Platform or its Content without prior written authorization, except to the extent permitted by law;

  • uses robots, scripts, scrapers, automated agents, or other technical means to collect, index, scrape, or exploit the Content or data of the Platform without authorization;

  • transmits, through the Platform, any content containing malicious code, viruses, ransomware, Trojan horses, or any other harmful element;

  • uses the Platform in a manner that could compromise its availability, performance, integrity, or security.

4. Purpose of the Platform

The purpose of the Platform is to facilitate access to digital resources, information, self-care tools, and content of interest to citizens and healthcare professionals.

Unless expressly stated otherwise, the Platform is provided for informational, educational, guidance, and referral purposes. It does not constitute a medical service, a medical record, an emergency service, or a tool for diagnosis, treatment, or individualized clinical follow-up.

5. No Medical Advice and Emergency Situations

The Content and features of the Platform do not constitute medical advice, a diagnosis, a prescription, a therapeutic recommendation, or a substitute for the assessment, judgment, or care of a qualified professional.

You must not use the Platform to obtain a response to a medical, psychiatric, or safety emergency. In case of emergency, or if you believe that a person is in immediate danger, call 911 or immediately contact the appropriate emergency services or a qualified healthcare professional.

AppGuide does not guarantee that the Content or referenced resources are appropriate for your particular situation, health condition, personal needs, or professional context.

6. External Content and Third-Party Tools

The Platform may contain links to websites, portals, applications, directories, content, or digital tools operated by third parties (“Third-Party Resources”).

These links and references are provided for convenience and in good faith only. AppGuide does not exercise continuous control over Third-Party Resources and does not necessarily endorse their content, accuracy, availability, security, privacy practices, terms of use, or regulatory compliance.

Your use of any Third-Party Resource is governed by the policies, terms, and practices applicable to that third party. It is your responsibility to review them before using a Third-Party Resource.

AppGuide shall not be held responsible for the availability, interruption, content, changes, errors, omissions, or practices of any Third-Party Resource.

7. Artificial Intelligence and Automated Features

The Platform may include, as applicable, recommendation, ranking, assistance, analysis, or automation features, including features based in whole or in part on algorithmic or artificial intelligence processes.

These features are provided to improve accessibility, content relevance, user experience, security, or the effectiveness of the Platform. They remain informational or assistive in nature and do not replace human, professional, clinical, or legal judgment.

Unless expressly stated otherwise, the Platform is not intended to make fully automated decisions about you that produce legal effects or similarly significant effects.

You remain responsible for your use of the information, recommendations, results, or content generated, displayed, ranked, or suggested by the Platform.

8. Account, Communications, and Information Provided

Certain features of the Platform may require you to provide certain information or communicate with us.

You represent that the information you provide is accurate, up to date, and complete, and you agree to update it when necessary.

You remain responsible for any use of the Platform made using your access credentials, where applicable, and you must take reasonable measures to preserve their confidentiality.

Unless otherwise indicated, the Platform and its Content are protected by applicable intellectual property laws, including laws relating to copyright, trademarks, designs, databases, and trade secrets.

All rights, titles, and interests in and to the Platform and its Content belong to AppGuide or their respective owners.

No right, title, licence, or interest is granted to you other than the limited, revocable, non-exclusive, and non-transferable right to access and use the Platform in accordance with these Terms.

10. Protection of Personal Information

AppGuide places great importance on the protection of personal information and applies governance, security, and confidentiality measures appropriate to the nature of its activities.

Use of the Platform may result in the collection and processing of certain personal information in accordance with our Privacy Policy.

11. Security and Availability

AppGuide implements reasonable administrative, technical, and physical measures to protect the Platform and the information processed against unauthorized access, use, disclosure, modification, or destruction.

Despite these measures, no technological environment, online service, transmission, or system is entirely free from risk. AppGuide therefore does not guarantee that the Platform will be accessible uninterrupted, secure, complete, error-free, or available at all times.

We may suspend, restrict, withdraw, or modify, in whole or in part, the Platform or certain features, with or without notice, including for reasons of maintenance, security, compliance, improvement, or operations.

12. Disclaimer of Warranties

Subject to applicable laws, the Platform and its Content are provided “as is” and “as available”.

To the fullest extent permitted by law, AppGuide disclaims any representation, condition, or warranty, whether express, implied, or statutory, including any warranty of:

  • merchantability;

  • fitness for a particular purpose;

  • accuracy, completeness, relevance, or timeliness;

  • absence of errors, interruptions, or failures;

  • continuous availability;

  • compatibility with your devices, software, systems, or needs;

  • non-infringement of third-party rights.

13. Limitation of Liability

To the fullest extent permitted by applicable laws, AppGuide, its officers, directors, employees, representatives, partners, suppliers, and agents shall not be liable for any direct, indirect, incidental, consequential, exemplary, punitive, or special damages, including any loss of data, revenue, opportunities, goodwill, reputation, or operations, arising out of or related to:

  • your access to the Platform, your use of it, or your inability to use it;

  • any error, omission, or inaccuracy in the Content;

  • any reliance placed on the Content or Third-Party Resources;

  • any interruption, unavailability, failure, vulnerability, attack, virus, or technological incident;

  • any unauthorized use of the Platform or its systems;

  • any decision made or not made based on the information or features offered by the Platform.

Without limiting the foregoing, you acknowledge that your use of the Platform is at your own risk.

14. Indemnisation

You agree to indemnify, defend, and hold harmless AppGuide, its affiliated companies, officers, directors, employees, representatives, agents, and suppliers from and against any claim, demand, action, liability, loss, cost, or expense, including reasonable legal fees, arising from:

  • your use of the Platform;

  • your breach of these Terms;

  • your violation of any applicable law or any third-party right;

  • any information you transmit or make accessible through the Platform, where applicable.

15. Suspension or Termination of Access

AppGuide may, at its discretion and without liability, suspend, limit, or terminate your access to all or part of the Platform if it reasonably believes that you are in breach of these Terms, any applicable law, or the security, integrity, or proper functioning of the Platform.

16. Changes

AppGuide reserves the right to modify these Terms of Use at any time.

The version in effect is the version displayed on the Platform as of the last updated date indicated at the top of this document. Your continued use of the Platform after the modified Terms have been published constitutes your acceptance of them.

17. General Provisions

AppGuide’s failure to exercise any right or remedy provided under these Terms does not constitute a waiver of that right or remedy.

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

These Terms constitute the entire agreement between you and AppGuide regarding the use of the Platform and replace any prior agreement, communication, or version relating to the same subject matter.

19. Governing Law

These Terms are governed by the laws in force in the province of Quebec and the federal laws of Canada applicable in that province.

Subject to applicable mandatory rules, any dispute relating to the interpretation, validity, performance, or application of these Terms shall be submitted to the competent courts of the judicial district of Montréal, province of Quebec.

20. Language of the Terms

These Terms of Use are available in French and English. In the event of any discrepancy between the two versions, the French version shall prevail.
